Fleet Claims Portal & Fleet Customer Portal - Terms of Use -

These terms and conditions (Terms of Use) apply to any access to or use of (1) the Fleet Claims Portal by Fleet Drivers, and (2) the Fleet Customer Portal by Fleet Admin Users. By accessing or using the Fleet Claims Portal or the Fleet Customer Portal, Fleet Drivers and Fleet Admin Users (as applicable) are deemed to have unconditionally accepted these Terms of Use.

  1. Definitions
    Crash Management means Crash Management Services Ltd (NZBN 9429031868945) of Level 5, Building 5, Central Park 666 Great South Road, Ellerslie, Auckland 1051.
    Crash Management Privacy Policy means the privacy policy available at https://www.dinggo.co.nz/privacypolicy.
    Fleet Admin Account means an account created by or on behalf of a Fleet Admin User for the purpose of using the Fleet Customer Portal.
    Fleet Admin User means any individual, company, organisation or business authorised by the Fleet Customer to access and use the Fleet Customer Portal for the Permitted Purpose.
    Fleet Customer means a fleet customer receiving accident management services from Crash Management.
    Fleet Claims Portal means the web portal available at https://claims.dinggo.co.nz that enables Fleet Drivers to lodge a digital FNOL.
    Fleet Customer Portal means the web portal accessible via the website available at https://www.dinggo.co.nz that enables Fleet Admin Users to access and use Information and perform other authorised actions in relation to accident management services being provided by Crash Management to the Fleet Customer.
    Fleet Driver means the designated driver of a vehicle that is designated as part of the Fleet Customer’s fleet of vehicles.
    FNOL means first notification of loss following an incident involving a vehicle that is designated as part of the Fleet Customer’s fleet of vehicles.
    Information means all information, content, documents, material, data, files, pictures, images and any other information in any form relating to motor vehicle accident management and related services provided by (or on behalf of) Crash Management to the Fleet Customer.
    Permitted Purpose means any lawful purpose advised to a Fleet Admin User by the Fleet Customer and any lawful purpose reasonably incidental to that purpose.
  2. Terms for Fleet Drivers
    Access to and Use of Fleet Claims Portal
    Each Fleet Driver acknowledges and agrees that:
    1. they are granted access to and may use the Fleet Claims Portal solely for the purpose of lodging an FNOL;
    2. by using the Fleet Claims Portal to lodge an FNOL they unconditionally accept and agree to be bound by these Terms of Use as they apply to Fleet Drivers;
    3. lodgement of an FNOL will only have been completed when they have ‘checked’ an electronic box agreeing to these Terms of Use; and
    4. Crash Management does not guarantee that the running of the Fleet Claims Portal will be continuous and fault free.
    Personal Information & Privacy
    When a Fleet Driver lodges an FNOL, they will provide Crash Management with personal information such as their name, email address, telephone number, date of birth and driver’s licence number. A Fleet Driver must ensure that this information is accurate, complete and up to date. Crash Management will handle all personal information it collects from Fleet Drivers in accordance with the Crash Management Privacy Policy.
  3. Terms for Fleet Admin Users
    Registration
    Each Fleet Admin User must be registered to use the Fleet Customer Portal. Registration will only have been completed when a Fleet Admin User has ‘checked’ an electronic box agreeing to these Terms of Use. By completing the electronic application to access and use the Fleet Customer Portal and using the Fleet Customer Portal for any purpose, a Fleet Admin User unconditionally accepts and agrees to be bound by these Terms of Use as they apply to Fleet Admin Users.
    Personal Information & Privacy
    When a Fleet Admin User registers and activates a Fleet Admin Account, they will provide Crash Management with personal information such as their name, email address and telephone number. A Fleet Admin User must ensure that this information is accurate, complete and up to date. Crash Management will handle all personal information it collects from Fleet Admin Users in accordance with the Crash Management Privacy Policy.
    Fleet Admin Account Security
    Each Fleet Admin User is responsible for:
    1. safeguarding any user ID and password used to access their Fleet Admin Account and for ensuring that their user ID and password are used only by them; and
    2. any activity occurring in their Fleet Admin Account, whether or not they authorised that activity.
    If a Fleet Admin User becomes aware of any unauthorised access to, or use of, their user ID, password or Fleet Admin Account, they should immediately notify Crash Management by email to enquiries@crashmanagement.co.nz.
    Access to and Use of Fleet Customer Portal and Information
    Each Fleet Admin User acknowledges and agrees that:
    1. they are granted access to and may use the Fleet Customer Portal solely for the Permitted Purpose;
    2. all Information submitted or uploaded to, or downloaded from, the Fleet Customer Portal is confidential information of the Fleet Customer;
    3. they may only reproduce, use, disclose, or copy the Information for the Permitted Purpose;
    4. Crash Management does not guarantee that any Information downloaded from the Fleet Customer Portal or any Information submitted to or uploaded or displayed via the Fleet Customer Portal, is free from viruses or other harmful components that could cause loss to or interfere with external data, hardware or software;
    5. Crash Management does not guarantee that the running of the Fleet Customer Portal will be continuous and fault free;
    6. they must not:
      1. misuse the Fleet Customer Portal by interfering with its normal operation, or attempting to access it using a method other than through the interfaces and instructions Crash Management provides;
      2. circumvent or attempt to circumvent any limitations that Crash Management imposes on their Fleet Admin Account or access to the Fleet Customer Portal;
      3. transmit, or attempt to transmit, any viruses, malware, or other types of malicious software, or links to such software, through the Fleet Customer Portal; or
      4. use the Fleet Customer Portal in any way that infringes, or encourages the infringement of, a third party's rights, including intellectual property rights, confidentiality or privacy rights, or is otherwise unlawful.
  4. Variation of Terms of Use
    These Terms of Use may be varied by Crash Management at any time. Any variations to these Terms of Use will take effect from the time the varied Terms of Use are available at https://www.dingo.co.nz/termsofuse.
